A day in the life of an employment seat trainee…

This week, the trainee solicitor blog team caught up with Kelly Arnold.  Kelly is a final seat trainee in the Employment team.

8.30am:  I’m working in our London Cannon Green offices today.  After a much longer commute than usual I arrive at work and make myself a coffee.  I have a busy day ahead and my morning coffee always gets me off to a good start!  I review my to-do list and decide on my priorities for the morning.

9.00am:  A client has emailed with some queries and concerns around amending employees’ contracts of employment.  Amending employment contracts can be a sensitive process for employers and employees and can carry a degree of legal risk.  I prepare a guidance note to the client setting out the legal requirements to be aware of and procedure that should be followed in order to properly implement proposed contractual changes.

10.00am:  A member of the team has asked me to carry out some research into a new client.  It’s a really interesting organisation in the charity sector and I spend some time researching and putting together an email containing key information about the client and its work.  The client has asked us to review an agreement that it proposes to enter into for the provision of HR and payroll services from a third party.  I review the agreement, highlight the potential areas for concern or negotiation, and discuss the next steps with my colleague. 

10.30am:  I have been assisting with the preparation for a case due to be heard before the Employment Tribunal next month and my next task is to draft our client’s witness statements.  Our client is calling five witnesses to provide evidence and so I gather the necessary information that I need to assist with my drafting.  I draft the witness statements using the information provided by each of the witnesses and forward the drafts to our client for review.

12.00pm:  Next on my to-do list is to draft a consultancy agreement on behalf of our client that is intending to engage an individual on a consultancy basis for cross-border work.  I draft the consultancy agreement in accordance with the client’s instructions and make a note of areas that I’m a little unsure about to raise with my supervisor. 

1.00pm:  I am attending a lunchtime seminar today just a few doors down from our Cannon Green office.  The seminar topic is “Brexit:  The potential impact on your workforce” and my supervisor is due to talk about the effect of Brexit on workplace rights and UK employment law.  It’s a really important topic and something on the forefront of many of our clients’ minds.  The seminar provides useful insight into the effect of Brexit on immigration, employment law and the workplace and how employers can prepare for potential changes post-Brexit.

3.00pm:  It is the responsibility of the second year trainees at Cripps Pemberton Greenish to organise the annual summer party, our largest firm-wide social event.  I am in charge of gathering raffle prizes from local businesses to be used in the charity raffle on the evening of the summer party.  I contact some local businesses and am pleased to see that many are willing to donate.  All proceeds from the raffle will go to our charity of the year.  

3.30pm:  A partner in one of our commercial real estate teams has referred a client to the employment team with regards to a matter potentially relating to the Transfer of Undertakings (Protection of Employment) Regulations (TUPE).   If TUPE applies on a relevant transfer, employees of an outgoing employer automatically become employees of an incoming employer.  The regulations can be complex and confusing and there are strict consultation obligations that employers must adhere to.  I draft an initial advice note to the client based on the information that we have already been provided with and I suggest a call is arranged to go through the information and advice in further detail.

5.15pm:  I have been asked to produce a first draft of the employment team’s next blog post.  My topic of choice is the issues around suspending employees.  I note down some ideas and carry out some initial research so that I can make a start on drafting the blog post tomorrow morning.

6.00pm:  I head to the wine bar opposite the office for a catch-up with a colleague.
