Updated NHS terms and conditions for procuring goods and services
The Department of Health has updated the terms NHS bodies should use for buying in goods and services from commercial organisations, with or without a tender (see the link below). The changes reflect the new provisions in the Public Contract Regulations 2015, which include prompt payment requirements and obligations to comply with environmental, social and labour law requirements. The guidance includes:
- standard template contracts for procuring goods, services or combined goods and services
- contracts and notes for framework agreements, innovation partnerships and dynamic purchasing systems.
- standard purchase order templates
The guidance reiterates that the Department of Health will expect NHS bodies to use these terms without deviation for the goods and services covered (and will ask for an explanation where they are not followed), but that the terms must not however be used to commission clinical services. This must still be done using the NHS Standard Contract (which can be found at: https://www.england.nhs.uk/nhs-standard-contract/).
